1. Agreement to Terms

By downloading, installing, or using MusEQ ("the Software"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not download, install, or use the Software.

2. License Grant

Subject to your compliance with these Terms, the developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on macOS devices that you own or control, solely for your personal, non-commercial use.

3. Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Software;
  • Reverse engineer, decompile, or disassemble the Software, except as permitted by applicable law;
  • Remove, alter, or obscure any proprietary notices in or on the Software;
  • Use the Software for any unlawful purpose or in violation of any applicable laws or regulations;
  • Sublicense, rent, or lend the Software to any third party.

4. Intellectual Property

The Software and all related materials, including but not limited to code, graphics, user interface design, and documentation, are the intellectual property of the developer and are protected by copyright and other intellectual property laws. These Terms do not grant you any rights to the developer's trademarks, trade names, or service marks.

5. User Data and Privacy

MusEQ operates entirely on your local machine. The Software does not collect, transmit, or store any personal data, usage analytics, or telemetry. EQ profiles are stored locally on your device in plain text files under your Documents folder. You retain full ownership and control of all data created with the Software.

6. Third-Party Compatibility

The Software is designed to work with Apple Music and macOS audio output devices. The developer does not control and is not responsible for any third-party software, services, or hardware. Compatibility with third-party products is not guaranteed and may change without notice due to updates made by third parties.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE DEVELOPER'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Audio and Hearing Safety

The Software modifies audio output levels through equalization and pregain adjustments. While the Software includes automatic pregain management to help prevent clipping, the user is solely responsible for monitoring listening volume. The developer is not liable for any hearing damage or harm resulting from the use of the Software. Always listen at safe volume levels.

10. Updates and Changes

The developer may release updates to the Software from time to time. These updates may add, modify, or remove features. The developer reserves the right to modify these Terms at any time. Continued use of the Software after any such changes constitutes your acceptance of the revised Terms.

11. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of their provisions. Upon termination, you must cease all use of the Software and destroy all copies in your possession.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and the developer regarding the use of the Software and supersede all prior and contemporaneous written or oral agreements, proposals, or representations with respect to its subject matter.
